ABSTRACT. This paper considers two sets ethical obligations owed by a firm and its management to stockholders and employees with respect to layoffs. Literature and research from ethics and agency are used to frame ethical issues that pertain to age discrimination in layoffs. An actual court case provides an example for focus, analysis, and discussion. Points of discussion include management''s obligations to employees and factors of injustice related to prejudice against age.

This essay introduces a special report from The Hastings Center entitled Democracy in Crisis: Civic Learning and the Reconstruction of Common Purpose, which grew out of a project supported by the John S. and James L. Knight Foundation. This multiauthored report offers wide‐ranging assessments of increasing polarization and partisanship in American government and politics, and it proposes constructive responses to this in the provision of objective information, institutional reforms in government and the electoral system, and a reexamination of cultural (...) and political values needed if democracy is to function well in a pluralistic and diverse society. The essays in the special report explore the norms of civic learning and institutions, social movements, and communal innovations that can revitalize civic learning in practice. This introductory essay defines and explains the notion of civic learning, which is a lynchpin connecting many of the essays in the report. Civic learning pertains to the ways in which citizens learn about collective social problems and make decisions about them that reflect the duties and responsibilities of citizenship. Such learning can occur in many social settings in everyday life, and it can also be facilitated through participation in the processes of democratic governance on many levels. Civic learning is not doctrinaire and is compatible with a range of public goals and policies. It is an activity that increases what might be called the democratic capability of a people. (shrink)

ZappenKenneth Burke's concept of rhetoric is complex and elusive, increasingly so as it becomes intertwined and infused with dialectic in the long third part of A Rhetoric of Motives and in some essays published shortly thereafter (1951; 1955; 1969b [1950], 183–333).1 The connection between Burke's rhetoric and dialectic is well established (Brummett 1995; Crusius 1986; 1999, 120–21; Wess 1996, 136–216; Wolin 2001, 143–204), (...) and his concept of rhetoric as identification is widely recognized for its broadening of the traditional view of rhetoric as persuasion to include identification as a means of inducing cooperation and building communities (Crusius 1999, 120–21; Hauser 1986, 120–37; Henderson 1988, 33–34). Timothy W. Crusius establishes the fundamental relationship between A Grammar of Motives and A Rhetoric of Motives as dialectical and rhetorical counterparts and explains both the strengths and the limitations of identification as a means of inducing cooperation (1986). According to Crusius, dialectic explores the substance of a person or thing—all that "supports or 'substands'" it—from multiple and shifting perspectives, viewing human action dramatistically as act, scene, agent, agency, and purpose (24–28). Rhetoric complements dialectic and its multiple dramatistic perspectives by promoting "identification" and "cooperation," building "a community, a sense of oneness amid diversity of conflicting interests and values" (28–30). As Crusius and others observe, [End Page 279] however, identification as a means of inducing cooperation is inherently limited since any identification necessarily also entails a division: "Every 'us' requires a 'them'" (29; Biesecker 1997, 47–49; Wolin 2001, 177–78). Thus, for example, while Christianity provides a powerful instance of identification, it also provides an equally powerful illustration of its division from other peoples—"Satan and his counter-kingdom," "the Turk infidel," and "the pagan hordes of Asia" (28–29). For Burke, these divisions were largely political (George and Selzer 2007, 16–57, 110–32; Lentricchia 1983, 21–38). For us, they are differences of gender, culture, and economic and social class (Condit 1992), compounded by political, economic, and religious differences on a global scale. By this account, the first two parts of the Rhetoric offer at best a partial solution to the problem. The third part challenges and mystifies and in itself seems to offer little more than a utopian vision without purpose or outcome (Crusius 1999, 120–21; Wess 1996, 211–16; Wolin 2001, 201–3).2 Situated within the broader context of Burke's work, however, the third part seems rather to offer a bold and creative solution to the problem by merging dialectic and rhetoric with dialogue and poetic myth in a dialectical-rhetorical transcendence—a concept that merits a place alongside identification as a major contribution to rhetorical theory (1969b, 197–208, 221–33).3Burke's concept of dialectical-rhetorical transcendence developed over the course of more than twenty years, from the mid 1930s to the mid 1950s and beyond. Its sources are partly Hegelian and Marxist but increasingly Platonic,4 as Burke comes to perceive the Hegelian and Marxist concepts of history as part of the problem of competing ideologies and his version of Platonic transcendence as the solution—a solution that leads, on the one hand, toward "pure persuasion" and "ultimate identification" and, on the other, toward the pragmatics of a new rhetoric and a revolutionary program of lifelong education (1951; 1955; 1969b, 267–94, 328–33; Biesecker 1997, 43–47; Lee 2004; Wess 1996, 203–5, 211–16; Wolin 2001, 201–3). In the midst of the political divisiveness of the 1930s, Burke glimpsed in Hegel and even Marx the possibility of bridging conflicting ideologies via transcendence, but he turned to Plato in the Grammar and again in the Rhetoric to explain the processes by which opposing ideas and ideologies might merge in transcendent visions or myths that encompass what he perceived to be partial and partisan points of view. Those who have had the benefit of a reasonably lengthy familiarity with the philosophy of religion, and more particularly with the God question, may be so kind to a speaker long in exile from philosophy and only recently returned, as to subscribe, initially at least, to the following rather enormous generalization: meaning and truth, which to most propositions are the twin forces by which they are maintained, turn out in the case of claims about God, to be the centrifugal forces (...) by which they disintegrate. In simpler language, the greater the amount of intelligible meaning that can be given to the idea of God, the less grounds there would appear to be for assuming let alone asserting, that God exists, at least as a being distinguishable from all the things in this empirical world which are the source of the range of meanings available to us; on the other hand, the more we insist that God exists, a being over and above the things that make up this empirical world the less the amount of commonly available meaning we appear to be able to apply to God. Or, to put this in a manner which might obviate an obvious objection to it; either everything we know is tout ensemble , God, and then nothing in the world that we know is distinctively divine; or else nothing in this world is God, and then nothing that we appear to be able to know is God. In this unique work, James P. Sterba argues that traditional ethics has yet to confront the three significant challenges posed by environmentalism, feminism, and multiculturalism. He maintains that while traditional ethics has been quite successful at dealing with the problems it faces, it has not addressed the possibility that its solutions to these problems are biased in favor of humans, men, and Western culture. In Three Challenges to Ethics: Environmentalism, Feminism, and Multiculturalism, Sterba examines each of these challenges. In (...) the case of environmentalism, he argues that traditional ethics must incorporate conflict resolution principles that favor nonhumans over humans in a significant range of cases. In terms of feminism, he maintains that traditional ethics should rule out gendered family structures and implement an ideal of androgyny. In regard to multiculturalism, he contends that traditional ethics must endorse an ethics that is secular in character and that can survive an extensive comparative evaluation of both Western and non-Western moral ideals and cultures. The only textbook devoted to this topic, Three Challenges to Ethics is an engaging text for introductory courses in ethics and moral problems and is also interesting and provocative reading for scholars and general readers. James P. Sterba offers something that philosophers have long sought: an argument showing that morality is rationally required. Furthermore he argues that morality requires substantial equality. Even libertarian perspectives, which would seem to require minimal enforcement of morality, are shown to lead to a requirement of equality.

This book conveys the breadth and interconnectedness of questions of justice - a rarity in contemporary moral and political philosophy. James P. Sterba argues that a minimal notion of rationality requires morality, and that a minimal libertarian morality requires the welfare and equal opportunity endorsee by welfare liberals and the equality endorsed by socialists, as well as a full feminist agenda. Feminist, racial, homosexual, and multicultural justice, are also shown to be mutually supporting. The author further shows the compatibility (...) between anthropocentric and biocentric environmental ethics, as between just war and pacifist theories. Finally, he spells out when normal politics, legal protest, civil disobedience, revolutionary action, and criminal disobedience are morally permitted by justice for here and now. This highly original and potentially controversial book is ideal for courses in moral and political philosophy, applied ethics, women's studies, environmental studies, and peace studies. (shrink)

BackgroundPlagiarism is common and threatens the integrity of the scientific literature. However, its detection is time consuming and difficult, presenting challenges to editors and publishers who are entrusted with ensuring the integrity of published literature.MethodsIn this study, the extent of plagiarism in manuscripts submitted to a major specialty medical journal was documented. We manually curated submitted manuscripts and deemed an article contained plagiarism if one sentence had 80 % of the words copied from another published paper. Commercial plagiarism detection software (...) was utilized and its use was optimized.ResultsIn 400 consecutively submitted manuscripts, 17 % of submissions contained unacceptable levels of plagiarized material with 82 % of plagiarized manuscripts submitted from countries where English was not an official language. Using the most commonly employed commercial plagiarism detection software, sensitivity and specificity were studied with regard to the generated plagiarism score. The cutoff score maximizing both sensitivity and specificity was 15 % (sensitivity 84.8 % and specificity 80.5 %).ConclusionsPlagiarism was a common occurrence among manuscripts submitted for publication to a major American specialty medical journal and most manuscripts with plagiarized material were submitted from countries in which English was not an official language. The use of commercial plagiarism detection software can be optimized by selecting a cutoff score that reflects desired sensitivity and specificity. (shrink)

In conversation, individuals work together to achieve communicative goals, complementing and aligning language and body with each other. An important emerging question is whether interlocutors entrain with one another equally across linguistic levels (e.g., lexical, syntactic, and semantic) and modalities (i.e., speech and gesture), or whether there are complementary patterns of behaviors, with some levels or modalities diverging and others converging in coordinated fashions. This study assesses how kinematic and linguistic entrainment interact with one another across levels of measurement, and (...) according to communicative context. We analyzed data from two matched corpora of dyadic interaction between—respectively—Danish and Norwegian native speakers engaged in affiliative conversations and task‐oriented conversations. We assessed linguistic entrainment at the lexical, syntactic, and semantic level, and kinetic alignment of the head and hands using video‐based motion tracking and dynamic time warping. We tested whether—across the two languages—linguistic alignment correlates with kinetic alignment, and whether these kinetic‐linguistic associations are modulated either by the type of conversation or by the language spoken. We found that kinetic entrainment was positively associated with low‐level linguistic (i.e., lexical) entrainment, while negatively associated with high‐level linguistic (i.e., semantic) entrainment, in a cross‐linguistically robust way. Our findings suggest that conversation makes use of a dynamic coordination of similarity and complementarity both between individuals as well as between different communicative modalities, and provides evidence for a multimodal, interpersonal synergy account of interaction. This book combines the two most common approaches used to introduce students or general readers to ethics: the historical and the applied. Using these approaches, Sterba examines traditional ethical theories and disagreements, exploring Aristotelian, Kantian, and utilitarian ethics, as well as their contemporary defenders. But rather than focusing on formal aspects of these views, Sterba applies the best practical arguments from each of these perspectives to a variety of moral problems, such as sexual harassment, affirmative action, and international terrorism and (...) the second Iraqi war. I clarify a widely accepted form of contemporary naturalism and argue that supervenient physicalism should not be considered an option for those who embrace this version of naturalism. Among other things, my thesis implies that if there are insuperable difficulties for strict physicalism, then the move toward supervenience views of the mind/body problem amounts to an abandonment of this version of naturalism and not a minor adjustment of it. More precisely, my argument is this: strict physicalism excludes both substance and (...) property or event dualism. But the supervenience thesis entails some form of property or event dualism. So strict physicalism excludes the supervenience thesis. Moreover, given the nature of a widely accepted contemporary understanding of naturalism, it is best construed along strict physicalist lines and naturalists of this persuasion should not be supervenient physicalists. To make my case, I offer a characterization of a ubiquitous version of contemporary naturalism followed by an analysis of the most plausible version of supervenient physicalism consistent with this form of naturalism. I then try to show why this version of supervenient physicalism should not be an option for a naturalist of a certain persuasion. (shrink)

Biocentrists are criticized (1) for being biased in favor of the human species, (2) for basing their view on an ecology that is now widely challenged, and (3) for failing to reasonably distinguish the life that they claim has intrinsic value from the animate and inanimate things that they claim lack intrinsic value. In this paper, I show how biocentrism can be defended against these three criticisms, thus permitting biocentrists to justifiably appropriate the salutation, “Let the life force (or better (...) the ethical demands of life) be with you.”. I propose to show that when the most morally defensible versions of an anthropocentric environmental ethics and a nonanthropocentric ethics are laid out, they would lead us to accept the same principles of environmental justice.

In this introduction, I summarize the main themes of my book, particularly those that my critics have focused on in their papers that follow. I also argue that I could not have reached the conclusions that I have if I hadn’t employed a peacemaking rather than a warmaking way of doing philosophy. I provide a characterization of a peacemaking way of doing philosophy and show how the conclusions of my book depend on doing philosophy in that way.

This chapter discusses some of the most engaging natural phenomena, those in which highly structured collective behavior emerges over time from the interaction of simple subsystems. Emergence is generally understood to be a process that leads to the appearance of structure not directly described by the defining constraints and instantaneous forces which control a system. Over time “something new” appears at scales not directly specified by the equations of motion. An emergent feature also cannot be explicitly represented in the initial (...) and boundary conditions. A feature emerges when the underlying system puts some effort into its creation. These observations form an intuitive definition of emergence. For it to be useful, however, one must specify what the “something” is and in what manner it is “new.” Otherwise, the notion has little or no content, since almost any time-dependent system would exhibit emergent features.
